Nexus Car Rental | Terms of Service (USA & Canada)

1. Acceptance of Terms

By accessing or using the Nexus Car Rental website, mobile application, or any of our rental services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a legally binding agreement between you ("User", "Renter", "You") and Nexus Car Rental ("Nexus", "We", "Us", "Our"). If you do not agree with any part of these Terms, you may not use our Service.

                     Electronic Consent: By using our Service, you consent to receive electronic communications from us (e.g., email, SMS, push notifications) regarding your rental, updates, and promotional offers. You may opt out of marketing messages at any time.
                

2. Rental Eligibility

Age & License:

Minimum age to rent: 21 years (USA) / 21 years (Canada) at most locations.
Drivers 21‑24 pay a Young Driver Fee (varies by location).
Valid, non‑expired driver’s license (physical copy) – digital licenses not accepted.
International renters: valid passport + home country license + International Driving Permit recommended.

Payment & Deposit:

A major credit card (Visa, Mastercard, Amex, Discover) in the renter’s name is required at pick‑up.
Security deposit: $100–$500 (refundable) depending on vehicle class and rental length.
Debit cards accepted only at select locations; subject to additional verification and deposit.

Additional Drivers: Must meet the same age/license requirements and be listed on the rental agreement. Unauthorized drivers void all insurance and hold the renter fully liable.

3. Booking & Payment

All bookings are subject to availability. Rates displayed at the time of booking are estimates and may include taxes, fees, and surcharges (e.g., airport concession fees, vehicle license fees). Your final total will be confirmed at pick‑up. Payment is due in full at the start of the rental unless a “Pay Later” option was selected during checkout (then payment is due at return).

Authorization Hold: At pick‑up, we place a hold on your credit card for the estimated rental charges plus the security deposit.
Currency: All transactions are processed in USD (for US rentals) or CAD (for Canadian rentals). Your bank may apply exchange fees for cross‑border payments.
Price Guarantee: Once a reservation is confirmed, the daily rate is locked. However, taxes, fees, and surcharges may change between booking and pick‑up.

4. Cancellation Policy

Free Cancellation: Cancel at least 48 hours before scheduled pickup – full refund. Cancel within 48 hours of pickup: one day’s rental fee may be retained. No‑show reservations are non‑refundable.

Early Return: No refund for unused days. If you extend the rental, you must obtain approval from Nexus; unauthorized extensions may be charged at a premium rate.

Modifications: Changing pickup/drop-off times or locations may affect the rate; any difference will be charged or refunded accordingly.

5. Insurance & Liability

Collision Damage Waiver (CDW/LDW):

Reduces your financial responsibility for damage or theft of the rental vehicle.
You may decline CDW if your personal auto policy or credit card provides coverage; we will verify.
In Canada, mandatory third‑party liability of CA$1,000,000 is included.

Supplemental Liability Insurance (SLI):

Provides additional third‑party liability above basic limits for an extra daily fee.
Personal Accident Insurance (PAI) and Personal Effects Coverage (PEC) are also available at the counter.

Important: You are fully responsible for any damage or loss not covered by your chosen protection products. Unauthorized use, off‑roading, towing, or driving under the influence voids all coverage.

6. Vehicle Use Restrictions

Permitted Use: Paved public roads only. No off‑road, racing, towing, or commercial use (e.g., Uber, Lyft, deliveries) without prior written consent.
Prohibited Activities: Smoking (minimum $250 cleaning fee), transporting hazardous materials, carrying more passengers than seatbelts, or driving while intoxicated.
Geographic Restrictions: Vehicles rented in the USA or Canada may not be driven into Mexico. Driving into Alaska or remote northern territories may be restricted – contact Nexus before your trip.
Return Condition: Vehicle must be returned with a full fuel tank (or battery charge ≥75% for EVs) and in reasonably clean condition. Excessive dirt, pet hair, or odors may incur cleaning fees.

                     Tolls & Violations: You are responsible for all tolls, parking tickets, speed camera fines, and corresponding administrative fees. Nexus will charge your credit card for any citations received during your rental.
                

7. Cross‑Border Travel (USA ↔ Canada)

Nexus permits cross‑border travel between the United States and Canada under the following conditions:

You must notify Nexus at the time of booking or before pickup. A cross‑border fee may apply.
You must carry your rental agreement, passport (or Nexus trusted traveler card), and valid driver’s license at all times.
Insurance coverage (including CDW) remains valid in both countries, but you must comply with all local traffic laws.
Vehicles rented in Canada may be driven into the US but not into Mexico. US‑rented vehicles may be driven into Canada with prior authorization.

Document Checklist: Rental agreement, driver’s license, passport or enhanced ID, proof of insurance (provided in your rental folder), and credit card used for booking.

8. Electric Vehicle (EV) Terms

EVs must be returned with a minimum battery charge of 75%. A charging fee + service surcharge applies if below that level.
Use only approved charging networks (Electrify America, ChargePoint, Flo). Damage to the charging port due to improper use is your responsibility.
Roadside assistance for EVs includes mobile charging trucks (additional fee).
You are encouraged to use the Nexus app to locate charging stations along your route.

9. Privacy & Data Collection

We collect personal information (name, address, driver’s license, payment details) to process rentals, verify identity, and comply with legal obligations. We may share your information with law enforcement if required. For full details, refer to our Privacy Notice. By using our Service, you consent to the collection and use of your information as described.

We may also use your data to send you promotional emails and offers; you may opt out at any time by clicking “unsubscribe” in the email or contacting support.

10. Limitation of Liability

To the maximum extent permitted by law, Nexus Car Rental shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or related to your use of the Service or your rental of a vehicle, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your rental shall not exceed the amount you paid for the rental in question.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you. This section does not affect your statutory rights as a consumer.

11. Modifications to Terms

Nexus reserves the right to update or change these Terms of Service at any time without prior notice. The most current version will be posted on our website with the “Last Updated” date. It is your responsibility to review these Terms periodically. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
